The presumption in r 15.23 applies and was not displaced in respect of the Napier City Council, so costs were awarded to the nineteenth and twentieth third parties against the Council; however costs were declined against Equus Industries Ltd and Brian Greenall because they were in a similar position to the applicants and participated in settlement processes such that it would be unfair to order them to pay.
