The tenancy was periodic so s7 did not apply; the Tenancy Tribunal had ample evidential foundation that the s51 90-day notice was valid and not retaliatory under s54; further evidence was not admissible on this s119 appeal; accordingly the High Court dismissed the appeal and upheld the Tribunal and District Court decisions.
