The application fails because the plaintiff did not establish, on the evidential material presented, that the Draft Plan changes would directly or indirectly significantly affect the cost to the Council in terms of s97(1)(d); absent such a foundation s97 is not engaged and the Council's decision to enter the contract was not unlawful.
