The Court held that the interest provisions in s114 of the 2001 Act and the predecessor provisions (s72 of the 1992 Act and s101 of the 1998 Act) permit only simple interest; the Reviewer's substitution awarding compound interest was contrary to the Court of Appeal's authoritative interpretation in Robinson and must be quashed, restoring the appellant's original calculation.

The wording of s72 is clear: it allows interest on compensation calculated under the Act when payment is late but does not treat interest as part of the compensation base; accordingly interest-on-interest is not permissible and the respondent's calculation of simple interest was correct and is confirmed.

The appeal was allowed by consent and the Review Decision quashed because the Court of Appeal held that the Act's interest provision permits simple interest only; therefore the Reviewer's award of compound interest could not stand and the appellant's primary decision calculating simple interest was reinstated.
