Where a solicitor had clear instructions from the client to continue the proceeding and to file the amended statement of claim and had taken reasonable steps to confirm its contents before the deadline, the solicitor was authorised to file the document and thereby complied with rr 5.36 and 5.37; accordingly the proceeding should not be struck out but further directions should be given to remedy deficiencies (client confirmation and addition of respondents).
