On the basis of the forensic psychiatric risk assessment identifying ongoing psychotic symptoms, substance-related risk, limited insight, antisocial personality traits and intellectual disability, and having regard to the agreed joint memorandum, detention as a special patient under s24(2)(a) CP(MIP) Act 2003 at the Mason Clinic was necessary to provide intensive treatment and to protect the public.

Given the unanimous expert evidence of psychosis causing the killing, the history of multiple psychotic episodes involving dangerous driving, the high risk of similar conduct on relapse, poor engagement with treatment, comorbid disorders and substance use, the court concluded that detention as a special patient under s 24(2) of the CPMIP Act was necessary to protect the public and therefore ordered detention as a special patient.

On the balance of probabilities psychiatrists' expert evidence established defendant suffered schizophrenia (a disease of the mind) and, because of delusions and command hallucinations, did not know the killing was morally wrong; that satisfies s23; s20(2) requirements were met and the only appropriate disposition in the interests of public safety was detention as a special patient under s24.
