The court found on the balance of probabilities that Mr Walker personally executed legally sufficient guarantee documents meeting s2 of the Contracts Enforcement Act 1956, thereby guaranteeing FIGL's loan obligations, and that an order under s248 Companies Act 1993 should be made to permit judgment to be entered against FIGL; accordingly judgment was entered against FIGL and Mr Walker for the specified sums.
