Cruickshank v Accident Compensation Corporation
- Citation
- [2011] NZACC 130
- Court
- District Court
ACC could not recover the full $3,700.11 because the appellant remained legally incapacitated for the period and ACC had not followed the statutory procedures required to cancel or terminate entitlement; ACC is limited to recovering the difference between gross weekly compensation paid and the amount after abatement for any earned income, and absent evidence of earnings there was no basis to recover the $3,700.11.
