On the balance of probabilities the Court accepted the expert opinion of Mr Hooker (supported as a possibility by Mr Kelman) that the 28 June 1988 accident caused a significant superimposed injury on previously asymptomatic degenerative change and materially contributed to the present need for total knee replacement; accordingly ACC's decision declining funding was revoked and replaced with approval for funding and costs awarded.
