The Court found no extenuating circumstances under s135(3): the file showed repeated and clear notification of review rights and time limits, no medical or other evidence that the injury prevented timely filing, the claimant consciously pursued alternative options and delayed further despite being given late review forms and advice, therefore ACC was correct to decline the late review and the appeal is dismissed.
