On the evidence the solicitor's affidavit established that the deceased instructed revocation of the prior will and execution of the draft will, the deceased's handwritten amendments reflected his testamentary intentions, he had capacity, and all affected parties consented; accordingly the draft will together with the handwritten notes are declared the valid last will under s 14 Wills Act 2007.
