The judge dismissed the r 7.49 application because the strike‑out decision followed a full hearing, the applicant produced no fresh, material or overlooked evidence, there was no material change in circumstances or other special circumstance, and the application amounted to improper relitigation/appeal; accordingly the recission application was misconceived and dismissed, with no basis for transfer to the Court of Appeal.
