The appeals were dismissed because the appellant failed to show any error of law in the Environment Court decision, lacked standing or authority to appeal abatement notices addressed to registered owners, and did not rebut the Environment Court's factual and credibility findings; accordingly the High Court upheld the Environment Court's dismissal and strike out of the appeals.

The appeal was dismissed and the security for costs order of $620 was upheld because the proposed appeal lacked apparent merit, did not raise issues of public importance, and impecuniosity alone did not justify waiving security; accordingly the interests of justice required payment of reduced security within the extended time and the application to adduce further evidence was dismissed.

The proceedings were struck out because the alleged deficiencies in photographic simulations and omission of infrastructure works raised questions of degree on adequacy of environmental assessment where reasonable persons could differ and did not disclose a reasonable arguable reviewable error; combined with delay, prejudice to parties and the capacity of Environment Court processes to address defects, intervention by the High Court was inappropriate.
