Court concluded the LCRO took at least one irrelevant consideration into account (treating the applicant's refusal to withdraw the review in favour of an administrative referral as evidence of vexatiousness) and accordingly judicial review was granted on that ground; however the LCRO's reliance on the applicant's extensive history of vexatious conduct was a relevant consideration and there was insufficient evidence of bad faith or bias, so the appropriate remedy was to remit the matter to the LCRO for reconsideration and quash the LCRO's costs order.
