The High Court held that an arbitral tribunal such as the LCIA is a 'tribunal exercising jurisdiction' in a country outside New Zealand within s182, the Court has jurisdiction under s184, and in the exercise of its discretion it would not compel the respondent to give evidence by AVL at the London hearing but would order deposition in Christchurch by a High Court‑appointed examiner with counsel in the arbitration participating.
