The judge held there was sufficient circumstantial and direct evidence (text messages, CCTV, prompt meeting, travel and concealment of the vehicle, accommodation and ferry arrangements, purchase of razor and recorded conversations) from which a properly directed jury could reasonably infer that Ms Tarei knew of the killings and actively assisted Mr Fane to avoid arrest; therefore the s147 discharge application was dismissed and the charge must proceed to the jury.
