The Court dismissed the application for leave to appeal for lack of jurisdiction because the proceedings commenced in April 2012 are governed by s144 of the Summary Proceedings Act 1957; the applicant had to obtain High Court leave before seeking leave or special leave from this Court.

The Court of Appeal lacks jurisdiction to grant special leave to appeal where the High Court has refused an extension of time because such a refusal is not a determination arising in "any general appeal" under s144 of the Summary Proceedings Act 1957, and therefore the Court must dismiss the special leave application.

The Court dismissed the application for special leave for lack of jurisdiction because s144 of the Summary Proceedings Act 1957 applies only where an appeal has been heard in the High Court; a refusal by the High Court to extend time to appeal is not a matter within s144 for special leave to the Court of Appeal.
