The High Court allowed the appeal because, after applying modest guilty plea credit and larger discounts for background and rehabilitation and giving substantial credit for lengthy and restrictive EM bail (and noting remand time), any sentence of imprisonment would be manifestly excessive and would unjustly prevent Clean Slate Act relief; accordingly the imprisonment was quashed and substituted with six months' supervision concurrent on both charges.

STEPHENS v R [2023] NZCA 663

The Court held the starting point of 18 months was excessive given the evidence; there was no basis to find the value exceeded $10,000, a more appropriate starting point was about eight months with a one month uplift for utensils and mitigation reducing the sentence to imprisonment comparable to seven and a half months; in light of parity considerations and rehabilitation the Court quashed the home detention orders and substituted six months' supervision with special conditions.

The District Court's imposition of intensive supervision with an extensive whereabouts condition and electronic monitoring was unsupportable because the Judge failed to analyse whether standard supervision conditions could address rehabilitative and reintegration needs and whether special conditions met the statutory threshold; accordingly the intensive supervision sentence and its special conditions were quashed and substituted with a 12-month supervision order with tailored conditions.

DODDS v NEW ZEALAND POLICE [2020] NZHC 886

The Court concluded the District Court properly considered the appellant's mental health and personal circumstances, found that some personal responsibility remained despite mental illness, and determined that 100 hours' community work was within the legitimate sentencing range for the offending; any over-emphasis on general deterrence did not render the overall sentence manifestly excessive and the appeal was dismissed.
