The Court of Appeal held the appellant did have standing as a beneficiary to seek disclosure (standing arises from beneficiary status rather than requiring a proprietary right), but affirmed that the High Court judge did not err in exercising a discretion against ordering disclosure in the circumstances; the appeal was dismissed and the trial judge's refusal to order disclosure was upheld.
