Fresh, credible Mental Health Review Tribunal findings established the appellant suffered an abnormal state of mind causative of the offending and did not present a serious ongoing risk; when weighed against the proven employment and livelihood consequences of conviction, the direct and indirect consequences were out of proportion to the gravity of the offence; accordingly the High Court allowed the appeal and discharged the appellant without conviction.
