On the balance of probabilities the Court found the navicular fracture requiring surgery was caused by the 5 September 2009 accident and therefore ACC's decision to decline funding was incorrect; the appellant was entitled to have the surgery costs funded under Clause 1 Schedule 1 of the Accident Compensation Act 2001.
