The Court was satisfied the statutory threshold for issuing restraining orders under ss 21, 24 and 25 of the Criminal Proceeds (Recovery) Act 2009 was met and issued the orders sought, but concluded the 2004 Holden V.Y Commodore was not tainted property because Linda Carol Tofts acquired it with her own funds and had rightful possession and control, and therefore the vehicle was not restrained and was ordered returned to her.
