Leave to appeal was refused because the application was belated and the Court of Appeal's direction for a retrial was properly made in light of the position at the time (rejection of the evidence under s81 would have plainly caused injustice to the Crown); absence of an express finding of substantial wrong was not fatal and the interests of justice do not require grant of leave given the delay and changed evidential approach for the retrial.
