The appellant failed to prove on the balance of probabilities that his present incapacity (turns) is causally connected to the 1992 head injury because persuasive expert medical evidence (Mr Wallis) excluded recognised organic mechanisms linking the head injury to the turns, making the temporal association alone insufficient to establish entitlement under the Act.
