The Court consented under s124 and approved the deed under s133 because the trustee had power under the trust deed, the proposed sale, distributions and termination were consistent with the settlor's intentions, all adult beneficiaries had consented, the arrangement protected the interests of minor and unborn beneficiaries through provision to their parents and did not impair any vested interests, and the settlement promoted finality and family harmony.
