On the evidence the document dated 28 December 2017 satisfied the prerequisites of s14 Wills Act 2007 and plainly expressed the deceased's testamentary intentions; therefore the Court declared the document valid as the will of the deceased.

The journal entries, being in the deceased's handwriting, appearing to be testamentary in nature and having been created in New Zealand, satisfy the s14 threshold and may be validated as the deceased's will despite non‑compliance with s11 formalities.

The Court declared the handwritten 15 November 2005 document a valid will under s14 Wills Act 2007 because it plainly expressed the deceased's testamentary intentions and this was supported by witness affidavits; accordingly the Court granted Letters of Administration with Will Annexed to the residuary beneficiary Ronald Richard Kite and directed costs of the validation application be paid from the estate.

The document executed 15 December 2009, although witnessed by only one person and thus non‑compliant with s11, was held to express the deceased's testamentary intentions and, with evidence of inquiries locating no other will and consent from those who would be affected on intestacy, the Court validated the document under s14(2) of the Wills Act 2007.
