Although respondent met the statutory threshold and exhibited the s13(2) characteristics, not all were established to a high level and, crucially, the Court was not satisfied on the balance of probabilities that there was a very high risk of imminent serious violent offending as defined by the Act (i.e. that respondent would offend as soon as a suitable opportunity arose). Therefore a Public Protection Order was not justified and the application was declined.
