The appellant failed to establish an identifiable physical injury caused by treatment or by a decision not to provide treatment; there was no evidence Dr Helman's 29 August 2003 letter caused ACC to halt or delay funding or that any such decision caused a physical injury within the meaning of ss32-33, therefore no treatment injury was established and the appeal was dismissed.
