The appellant satisfied the onus that a valid application for interest was made before 1 July 1999: the 23 March 1999 letter together with subsequent oral communications constituted an application and s72 of the 1992 Act therefore applies; absence of respondent records did not negate the proved application and repetition of a claim by a lay claimant does not defeat an earlier valid application.
