By consent the Court granted the applicants' interim orders preserving the status quo by restraining the respondents from taking any further action consequential on setting or varying the TAC or TACC for PAU 5B and reserving costs and leave to apply, such orders to remain until further order of the Court.

Leave to appeal was granted because the case raises a real and arguable question of law whether the Minister complied with statutory requirements under s21 of the Fisheries Act 1996 when setting the kahawai TAC in 2004 and 2005, making the issue appropriate for Supreme Court consideration.
