Defendants failed to establish that the tender documents, the SQ contract and related working papers were relevant to matters actually pleaded; the plaintiff's affidavit (pricing manager) affirmatively denied any allowance or reimbursement from Singapore Airlines, removing any factual foundation for a passing-on defence and therefore no order for particular discovery should be made under r 8.19 given the current pleadings.
