On a fresh appraisal the Court concluded ACC's determination was within the lawful scope of clause 22(3); the claimant in effect contributed the Ford's value toward the Nissan and it was fair and reasonable for ACC to have declined reimbursement of the $1,500 trade-in deduction; appeal dismissed.
