Leave to bring a second appeal is declined because the applicant's complaints are primarily factual and case‑specific, do not raise matters of general or public importance under s237, and the applicant has not demonstrated a miscarriage of justice; credibility findings and counsel's tactical decisions were within the range of competent judgment and were upheld on the first appeal.

Although the prosecutor's cross-examination and closing invited an adverse inference from the appellant's limited pre-trial remark and thus breached s 32 Evidence Act 2006, the trial judge's unequivocal directions to the jury, together with the defence closing, sufficiently cured any prejudice so that no miscarriage of justice occurred; alleged trial counsel shortcomings likewise did not cause a miscarriage of justice.

Leave to appeal was refused because the Court was satisfied the Court of Appeal rightly confirmed the trial Judge's findings, the case against the applicant was strong, there was no reasonably arguable miscarriage of justice or error regarding Mrs Calder's evidence, and there was no evidence the principal fraudster would have given exculpatory testimony to justify further review.
