The Court declared the Document to be the valid will of Dorothy Jean Dwyer because, notwithstanding non-compliance with s11, the Document came into existence in New Zealand and the totality of evidence (email instructions, solicitor's drafting affidavit, affidavits from the de facto partner and supporting family members, and the circumstances of illness preventing signature) established that the Document expressed the deceased's testamentary intentions as required by s14(2).
