Respondents breached the contractual warranty by failing to procure a code compliance certificate and by not undertaking remedial work; they failed to assert any interest after service of the earlier judgment; consequently the Court entered judgment in favour of the applicants for the retention sum paid into Court with interest and awarded costs on a 2B basis, the sum reflecting the appropriate measure of damages in the circumstances.
