MacDonald v Accident Compensation Corporation
- Citation
- [2008] NZACC 48
- Court
- District Court
The court accepted credible evidence that the 2005 salary allocation was driven by legitimate accounting objectives (neutralising shareholders' current accounts and setting a fair market salary) and not by a purpose to inflate weekly compensation; therefore the return was not 'unreasonably influenced' under cl 31 and the returned income of $52,000 must be used for assessing weekly compensation.
