Extended, repeated non‑compliance with a court order to provide security for costs (order for $1.65m) over an inordinate period, coupled with evidence that available funding options were inadequate or speculative and that non‑performance was intentional in the requisite sense, justified striking out the proceeding under r 7.48 and r 15.2; however the court granted a single final 'unless' opportunity (compliance by 13 July 2020) and supervised a limited runway for the crowd‑funding initiative (to 30 June 2020) and subsequent timetable for hearing if complied with.
