The plaintiffs acted reasonably in commencing and continuing the proceedings against the Bolers until credible sworn evidence (Heron's affidavit) showed the Bolers had no involvement; the conduct did not meet the threshold of vexatious, frivolous or improperly continuing proceedings required for indemnity costs nor did it justify increased costs; costs on costs were declined as contrary to predictable and expeditious costs regime.
