Leave to appeal was granted but appeal dismissed: there was no abuse of process because the appellant would have given evidence at the first trial to meet the rape charge regardless of the withdrawn wounding charge, the respondent's unequivocal undertaking not to use prior evidence addressed any unfairness, and there was no prosecutorial misconduct warranting a stay.
