Judge found both defendants guilty; concluded Ross was the architect with actual knowledge and highest culpability; Wehipeihana was an active participant with actual knowledge but lesser culpability; set starting points at 5.5 years (Ross) and 5 years (Wehipeihana) then applied discounts for remorse, good character, health and admissions resulting in final sentences of 4 years 4 months (Ross) and 4 years 3 months (Wehipeihana); declined to impose minimum periods of imprisonment; rejected alternative non-custodial arrangements.
