Although there was an arguable case that the defendant's appointment involved excessive delegation and that a vacancy may have arisen through incapacity, the applicant failed to show a reasonable likelihood that the Court would disturb the liquidator's acts or decisions under s 284 because there was insufficient evidential foundation, limited prospect of financial benefit to creditors, and inadequate funds to justify reopening the liquidation; therefore leave was refused and the application dismissed.
