The Court awarded standard interlocutory costs to the defendants ($7,050.50 plus $500 disbursements) but declined to order additional wasted costs because both parties had contributed to delays and, critically, the defendants had earlier represented to the Court that no disadvantage would arise from consolidation and adjournment thereby estopping them from later claiming wasted expenditure; the interlocutory costs are appropriate to determine now.
