Because the applicant had genuine concerns and limited means and was acting in the perceived best interests of the child, the Court exercised its discretion to deny an award for opposing counsel fees but required the applicant to reimburse out-of-pocket disbursements that would normally be borne by the judicial review applicant; accordingly $1,417.14 was awarded to the second respondent for disbursements.
