The Court was satisfied the document dated 3 June 2022 plainly expressed the deceased's testamentary intention and therefore met the requirements of s14 of the Wills Act 2007; the document is declared her last will.

The unsigned drafted document was declared the deceased's will because it plainly represented his testamentary intentions and, although it did not meet s 11 formalities, it satisfied the statutory test in s 14; unanimous consent of affected parties supported validation.

The Court validated the solicitor's file note as the deceased's will because, although not executed or in the deceased's handwriting, the file note was sufficiently connected to the deceased by consistent extrinsic evidence (statements to his mother and daughter and his belief a will existed with the firm) such that it expressed his testamentary intentions within the exceptional circumstances permitted by s14 of the Wills Act 2007.
