The Court validated the transactions executed under the apparent authority of the settlors because they were within the trustees' discretionary powers, had been relied upon by parties, and invalidation would cause severe disruption; the Court removed the two individual trustees and appointed Perpetual Trust Limited as sole trustee and vested the trust assets (including identified land) in Perpetual subject to the trust deed.
