Proposed appointees Askin and Hilson were refused appointment because their prior intimate involvement in and signature to the sale process created real risks of conflict between personal interests and trustee duties and would not provide independent fresh judgment; accordingly, under s51 Trustee Act 1956 the Court appointed the Public Trustee as an independent trustee of the Burnett Mount Cook Station Charitable Trust pending further order.
