Because there was an impasse in estate administration and the defendant had not engaged with the proceedings despite evidence of service, the court was satisfied that under s51 Trustee Act 1956 it was appropriate to remove the existing trustees and appoint the Public Trust as sole trustee, subject to conditions requiring transfer of records and consultation with the absent trustee; accordingly the orders were granted.
