Because the Official Assignee disclaimed the unit leaving the applicant with no practical means to recover substantial levies, and because it is fair in the circumstances and consistent with statutory provisions to do so while preserving the registered mortgagee's interest, the Court will vest the unit in the body corporate under s119(1)(b).
