Freezing relief was refused: although Whitford had a tenable claim limited to sums arguably misapplied (notably the extinguished personal loan and forfeited deposit), the applicant failed to demonstrate a real risk of dissipation of assets or sale proceeds and failed to provide an adequate undertaking as to damages; accordingly the overall justice of the case did not justify the extraordinary freezing order.
