The Court found a breakdown between factions and that those claiming to be trustees had not been validly appointed or had acted contrary to the Trust Deed such that the trust was incapable of proper administration; consequently it was expedient and practicable to exercise the Court's s51 power to dismiss those claimants as trustees and appoint the Public Trustee as interim trustee to carry out a lawful process for election of new trustees, with voting limited to qualifying church members as at 1 March 2005 (18+ and regular attendees).
